for workshops, hands-on sessions, classes, and retreats

1. Scope of Application, Contracting Parties

(1) These Terms and Conditions apply to all contracts between Jeannette Kado (hereinafter “Provider”) and clients regarding coaching (one-on-one), group coaching (online/offline), workshops, and retreats.
(2) Any conflicting terms and conditions provided by clients will not be recognized unless the Provider expressly agrees to their validity in writing.

2. Conclusion of the Contract

(1) Offers made by the Provider are subject to change. A contract is concluded upon acceptance of the offer (via email confirmation or booking form) or upon confirmation of the appointment or issuance of an invoice.
(2) For online bookings, the contract is concluded upon confirmation of the booking.

3. Scope of Services, Distinction Between Coaching and Therapy

(1) The programs offered are designed to promote self-awareness, body awareness, reflection, and personal development.
(2) They are not a substitute for psychotherapy, medical treatment, or physical therapy, and do not constitute medical treatment. The provider does not make diagnoses or promise cures.

4. Eligibility Requirements

(1) Participation requires that participants be of legal age and in good mental and physical health. Any health limitations must be disclosed in advance.
(2) Clients act on their own responsibility; if they experience any symptoms, they should seek medical advice.
(3) A minimum number of participants may apply for groups and retreats (see Section 10).

5. Prices, Sales Tax, Payment

(1) The prices listed in the offer apply. If the provider applies the small business exemption (§ 19 UStG), no sales tax will be shown. If the provider switches to standard taxation, future prices will be subject to sales tax.
(2) Payment terms: unless otherwise agreed, 7 days after the invoice date; for individual sessions, no later than the day of the session.
(3) Advance payments:
• Groups / Workshops: 30% upon booking, balance 7–30 days before the start (depending on the offer).
• Retreats: 30% upon booking, balance 30 days before the start.
(4) Default occurs upon the due date if payment has not been made; statutory default interest applies.

6. Appointments, Rescheduling, and Cancellations by Customers

Individual Sessions:
(1) Rescheduling is free of charge up to 24 hours before the appointment; after that, the service is considered rendered (100% due).
(2) Packages (1 month / 3 months): Agreed-upon appointments are binding; the 1-month package must generally be completed within 6 weeks, and the 3-month package within 5 months. Unused appointments expire unless the delay is attributable to the provider.

Workshops:
(3) Cancellation: free of charge up to 30 days before the start; 29–14 days = 50%; 13 days or less = 100% of the participation fee. Substitute participants may be named free of charge.
(4) A one-time rescheduling to the next cohort is possible free of charge up to 14 days before the start (after that, only subject to availability).

Retreats:
(5) Cancellation: up to 60 days before the start date = 30% (deposit), 59–30 days = 60%, 29 days or less = 100% of the total price. Substitute participants may be named (a €50 rebooking fee may apply).
(6) Travel and accommodation costs incurred by third parties (flights, trains, hotels) are not part of the contract unless expressly agreed otherwise (see Section 11).

7. Right of Withdrawal (Consumers Only: Distance Sales)

(1) For services without a fixed date, a 14-day right of withdrawal applies from the conclusion of the contract.
(2) Exceptions (§ 312g(2) BGB):
• Leisure events with fixed dates (workshops, retreats, courses): no right of withdrawal.
• Services that have already begun, provided the customer has given express consent and is aware that the right of withdrawal expires upon full fulfillment of the contract.
(3) Digital content (e.g., recordings, workbooks) may be provided if customers give their express consent, in which case their right of withdrawal expires.
(4) See the appendix for the cancellation policy and sample form.

8. Confidentiality, Data Protection

(1) The Provider treats all information from the sessions as confidential.
(2) The Provider’s privacy policy applies (available on the website or as an attachment).
(3) Recordings (audio, video, or photos) are made only with the express consent of all participants.

9. Copyright and Rights of Use

(1) Documents, workbooks, and audio/video materials are protected by copyright.
(2) Use is limited to personal use; distribution, reproduction, or commercial use is permitted only with written authorization.

10. Implementation; Changes by the Provider

(1) The provider may change the location, time, or co-instructors to a reasonable extent for objective reasons.
(2) Minimum number of participants:
• Group coaching/workshops: 5 people (unless otherwise specified)
• Retreats: 8 people (unless otherwise specified)
If the minimum number is not reached, the provider may cancel or offer an alternative date. Fees already paid will be refunded; no further claims (e.g., travel/hotel costs) may be made.
(3) Force majeure / Illness: The provider may cancel or reschedule; fees paid will be refunded or credited toward alternative dates.

11. Retreats & Travel Tips

(1) Standard case: Customers book their own travel and accommodations (no package tour contract).
(2) Accommodations and meals may be included in the retreat price only if expressly agreed upon; travel services as defined by package tour law are not offered.
(3) Customers are responsible for their own travel, health, and trip cancellation insurance.

12. Liability

(1) The Provider shall have unlimited liability in cases of willful misconduct, gross negligence, and in cases of injury to life, limb, or health.
(2) In cases of simple negligence, the Provider shall be liable only for breaches of material contractual obligations (cardinal obligations), limited to foreseeable damages typical for this type of contract.
(3) Any further liability is excluded. Limitations of liability also apply to vicarious agents.

13. Gift Certificates

(1) Gift certificates and vouchers are redeemable for three years from the end of the year of issuance (statute of limitations).
(2) Refunds of the remaining value are not permitted, to the extent permitted by law.

14. Information on Online Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
(2) We are not obligated and are not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Liability Notice for Online Content

Online content (audio/video) is intended solely for relaxation and personal development and is not a substitute for medical or therapeutic treatment.

16. Final Provisions

(1) German law applies; mandatory consumer protection provisions of the country of residence remain unaffected.
(2) The place of jurisdiction—to the extent permitted—is Munich.
(3) Any amendments or additions to these Terms and Conditions must be made in writing.
(4) Severability clause: Any invalid provisions shall not affect the validity of the remaining provisions.
